These Terms of Service ("Terms") govern your access to and use of the AuraBox website, store, and products, operated by Atlas Trade Solutions LLC ("AuraBox," "we," "us," or "our"). By visiting our website or placing an order, you agree to these Terms. If you do not agree, please do not use our store.
1. OVERVIEW
AuraBox sells the AuraBox Music Player and related discs and accessories, including personalized ("custom") products. These Terms apply to all users, visitors, and customers of our store. We may update these Terms at any time by posting the revised version on this page with a new "Last updated" date. Your continued use of the store after changes are posted means you accept the updated Terms.
2. ELIGIBILITY
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By placing an order, you confirm that you meet this requirement and that the information you provide is accurate and complete.
3. PRODUCTS AND DESCRIPTIONS
We work to display our products, colors, and details as accurately as possible. However, we cannot guarantee that your screen displays colors accurately, and slight variations between product images and the item you receive may occur. Product artwork, disc designs, and lighting effects shown in promotional images are for illustration and may vary. We reserve the right to modify or discontinue any product at any time.
4. ORDERS AND ACCEPTANCE
Your order is an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspected fraud, pricing errors, or product unavailability. If we cancel an order after payment, we will issue a full refund for that order. Prices are shown in the currency displayed at checkout and may change at any time before an order is placed.
5. PRICING AND PAYMENT
All prices are subject to change without notice. In the event of a pricing error, we reserve the right to cancel any affected orders, even if the order has been confirmed. Payment is processed securely through our third-party payment providers. By submitting payment information, you represent that you are authorized to use the payment method.
6. SHIPPING AND DELIVERY
We ship worldwide. Shipping times and costs are described in our Shipping Policy. Delivery estimates are not guaranteed, and we are not responsible for delays caused by carriers, customs, or events beyond our control. Import duties or taxes, where applicable, are the responsibility of the customer.
7. PERSONALIZED AND CUSTOM PRODUCTS
Certain products are made to order based on the photos, music, and personalization details you provide. Because these items are produced specifically for you:
- Once a custom order enters production, it cannot be canceled or modified.
- Returns and refunds for custom and personalized products are subject to the restocking fees set out in our Return and Refund Policy.
- You are responsible for the accuracy of the details, spelling, images, and files you submit. We produce your order based on what you provide and are not responsible for errors in the content you supply.
8. USER-SUBMITTED CONTENT (PHOTOS AND MUSIC)
When you upload photos, images, music, or other files to personalize your product, you represent and warrant that:
- You own the content or have all necessary rights, licenses, and permissions to use it.
- Your content does not infringe any copyright, trademark, privacy, publicity, or other rights of any third party.
- Your content is not unlawful, defamatory, obscene, or otherwise objectionable.
You grant us a limited license to use, reproduce, and process your uploaded content solely for the purpose of producing and fulfilling your order. We do not claim ownership of your content and do not use it for any other purpose.
You agree to indemnify and hold AuraBox harmless from any claim arising out of content you submit, including claims of copyright or trademark infringement. We reserve the right to refuse or cancel any order containing content that we believe, in our sole discretion, is unlawful or infringing.
9. PRODUCT USE
The AuraBox Music Player is intended for personal, indoor use. It plays music from discs placed on the device and connects to a computer via USB Type-C for adding your own music files. The product does not use Bluetooth and does not require any subscription. You are responsible for using the product in accordance with any instructions provided. Misuse, unauthorized modification, exposure to liquids, or use outside the product's intended purpose may void any applicable warranty and is not covered by our return policy.
10. INTELLECTUAL PROPERTY
All content on our website — including the AuraBox name, logo, text, graphics, product designs, Edition artwork, and images — is the property of Atlas Trade Solutions LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or use our content without our prior written permission.
11. PROHIBITED USES
You agree not to use our store or products for any unlawful purpose, to interfere with the security or operation of the website, to submit false information, or to infringe the rights of others. We may terminate or restrict your access to the store if you violate these Terms.
12. DISCLAIMER OF WARRANTIES
Our store and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the website will be uninterrupted, secure, or error-free.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Atlas Trade Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the store or products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
14. INDEMNIFICATION
You agree to indemnify and hold harmless Atlas Trade Solutions LLC and its owners, employees, and partners from any claims, damages, or expenses arising out of your use of the store, your violation of these Terms, or your submitted content.
15. GOVERNING LAW
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the store shall be resolved in the state or federal courts located in Illinois, and you consent to their jurisdiction.
16. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
